The Biltong Bandit – Terms & Conditions

Welcome to The Biltong Bandit (“we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website (www.thebiltongbandit.co.za) (“Website”), your purchase of our biltong and related products (“Products”), and any associated services (“Services”).

By accessing our Website or purchasing our Products, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must stop using the Website immediately.
 

1. DEFINITIONS
 

  • “Customer”, “you”, “your” means any user of the Website or purchaser of our Products.

  • “Products” means any food goods or merchandise sold by The Biltong Bandit.

  • “Business Days” means Monday to Friday, excluding South African public holidays.

  • “CPA” refers to the Consumer Protection Act 68 of 2008.

  • “ECTA” refers to the Electronic Communications & Transactions Act 25 of 2002.
     

2. ONLINE ORDERS & ACCOUNT REGISTRATION

2.1 Registration

You may be required to create an account to place orders. You agree to:

  • Provide accurate and complete information

  • Keep your login credentials secure

  • Notify us immediately of any unauthorised access

We are not responsible for any loss arising from the misuse of your account.

2.2 Order Process

Your order constitutes an offer to purchase. We reserve the right to accept or reject any order for reasons including (but not limited to):

  • Stock availability

  • Pricing or description errors

  • Suspected fraud

  • Inability to verify payment

Order acceptance occurs only once we dispatch your Products.

2.3 Order Confirmation
You will receive an order confirmation via email. If you do not receive this within 10 minutes, please contact hello@thebiltongbandit.co.za.

3. PRODUCT INFORMATION

3.1 Accuracy

We take care to ensure that product information, images, and descriptions are accurate. However:

  • Actual products may vary slightly from images

  • Packaging may differ depending on batch

  • Weight variations may occur due to the nature of dried meat products

3.2 Ingredients & Allergens

Products may contain or come into contact with common allergens. Detailed ingredient lists and allergen notices are provided on product pages and packaging.
 

It is your responsibility to review ingredient and allergen information before purchase or consumption.
 

4. PRICING & PAYMENT

4.1 
Prices

All prices are:

  • Quoted in South African Rand (ZAR)

  • Inclusive of VAT

  • Subject to change without notice

4.2 Payment methods

We accept:

  • Credit and debit cards

  • EFT (order processed once funds reflect)
     

We reserve the right to refuse any transaction.

4.3 Pricing errors

If an incorrect price is displayed, we may cancel the order and issue a full refund.

 

5. ORDER CANCELLATIONS

5.1 Customer Cancellations

Orders may be cancelled before midnight on the day before dispatch.
 

After dispatch, cancellations cannot be accepted for perishable goods, except where required by the CPA (e.g., defective goods).


5.2 Supplier Cancellation

We may cancel an order due to:

  • Stock shortages

  • Pricing errors

  • Inability to deliver

  • Fraud concerns
     

You will receive a full refund in such cases.
 

6. DELIVERY

6.1 Area and Fees

Delivery is available within:

  • Cape Town (local delivery fee applies)

  • Selected regions across South Africa (fee calculated at checkout)

6.2 Delivery Times

  • Cape Town: 2–5 Business Days

  • Other areas: 5–7 Business Days
     

These timeframes are estimates and may vary.
 

6.3 Risk and Ownership

Risk transfers to you only once delivery has been completed (i.e., when an adult signs for the parcel).

If delivery fails due to incorrect details or failure to receive the package, redelivery fees may apply.

6.4 No Collection Option
Store pickup is currently not available.

 

7. RETURNS, REFUNDS & DEFECTIVE GOODS

7.1 Statutory Rights

​Nothing in these Terms limits your rights under the CPA. Consumers have up to six (6) months to return defective goods.


7.2 Perishable Products

Due to the nature of biltong and dried meat products:

  • We do not accept “change-of-mind” returns

  • Opened Products may only be returned if defective

  • You must notify us within 48 hours of delivery for practical inspection reasons
    (This does not limit your CPA rights.)
     

7.3 When We Offer a Refund or Replacement

You may return a Product if:

  • It is defective or unsafe

  • It is contaminated or spoilt within its Best Before date

  • It does not match its description

  • It was delivered in error
     

7.4 Return Procedure

Email hello@thebiltongbandit.co.za with:

  • Your name

  • Order/invoice number

  • Photos of the issue

  • Description of the problem
     

We will assess the claim and may arrange collection.
 

7.5 Liability for Return Costs

  • Defective goods: We cover collection costs

  • Incorrect orders / non-defective return requests: customer may be charged return fees


7.6 Refund Timing
Approved refunds will be processed within 14 Business Days to your original payment method.

8. INTELLECTUAL PROPERTY

All Website content—including logos, branding, text, product names, recipes, photographs, and marketing material—is the exclusive property of The Biltong Bandit (Pty) Ltd.
 

You may not:

  • Copy, reproduce, sell, or distribute any content

  • Use our trademarks without written consent

  • Scrape or harvest Website data

  • Use automated tools (bots) without permission
     

Unauthorised use may result in civil or criminal action.

9. MARKETING & COMMUNICATIONS

9.1 Consent

We only send marketing communications in compliance with POPIA.

  • You must opt in to marketing, OR

  • If you are an existing customer, we may send promotions related to similar products, with an easy opt-out link.


9.2 Unsubscribe

You may opt out at any time via:

Your withdrawal of consent does not affect lawful processing prior to opt-out.


10. LIABILITY & INDEMNITY

 

10.1 What We Are Not Liable For

To the fullest extent permitted by law, we are not liable for:

  • Delays caused by third-party couriers

  • Allergic reactions where ingredient information was provided

  • Spoilage caused by improper storage after delivery

  • Loss arising from misuse of Products

  • Loss of profits, indirect or consequential damages

 

10.2 What We Are Liable For

We remain liable only for:

  • Defective or unsafe Products under the CPA

  • Direct losses caused by our negligence

  • Obligations expressly stated in these Terms

10.3 Customer Indemnity

You agree to indemnify us against losses caused by:

  • Misuse or alteration of Products

  • Resale of Products without authorisation

  • Fraudulent or unlawful use of the Website


11. GOVERNING LAW & DISPUTES
 

These Terms are governed by South African law.

In the event of a dispute:
 

  1. Parties must first attempt informal resolution via email.

  2. If unresolved, disputes may be referred to:

    • The Western Cape Magistrates or High Court, or

    • The Cape Town Small Claims Court (where applicable)


12. CHANGES TO THESE TERMS

We may update or amend these Terms at any time. The latest version will always appear on our Website. Continued use of the Website constitutes acceptance of the updated Terms.
